{"id":2261,"date":"2023-08-18T08:32:03","date_gmt":"2023-08-18T16:32:03","guid":{"rendered":"https:\/\/blog.mozilla.org\/netpolicy\/?p=2261"},"modified":"2023-08-18T08:33:27","modified_gmt":"2023-08-18T16:33:27","slug":"mozilla-applauds-cfpb-for-taking-on-the-data-broker-ecosystem","status":"publish","type":"post","link":"https:\/\/blog.mozilla.org\/netpolicy\/2023\/08\/18\/mozilla-applauds-cfpb-for-taking-on-the-data-broker-ecosystem\/","title":{"rendered":"Mozilla applauds CFPB for taking on the Data Broker Ecosystem"},"content":{"rendered":"<p>Earlier this week, the Consumer Financial Protection Bureau (CFPB) <a href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/remarks-of-cfpb-director-rohit-chopra-at-white-house-roundtable-on-protecting-americans-from-harmful-data-broker-practices\/\">announced<\/a> that it will develop rules to prevent \u201cmisuse and abuse\u201d of people\u2019s sensitive information by <a href=\"https:\/\/s3.amazonaws.com\/files.consumerfinance.gov\/f\/documents\/cfpb-data-broker-rulemaking-faq_2023-08.pdf\">placing restrictions<\/a> on data sharing by data brokers. This is a much-needed step to advance privacy, give people more control over their data, and shed light on a notoriously murky industry.<\/p>\n<p>In <a href=\"https:\/\/docs.house.gov\/meetings\/IF\/IF02\/20230419\/115788\/HMTG-118-IF02-Wstate-ErwinM-20230419.pdf\">Congressional testimony<\/a> and <a href=\"https:\/\/foundation.mozilla.org\/en\/blog\/is-my-facebook-activity-fcking-my-finances-mozilla-explains-data-brokers\/\">advocacy<\/a>, Mozilla has raised concerns about the opaque state\u00a0of the data broker industry; it\u2019s nearly impossible to fully understand the extent of data selling and sharing today. For this reason, <a href=\"https:\/\/foundation.mozilla.org\/en\/privacynotincluded\/about\/methodology\/\">our methodology<\/a> for assigning *Privacy Not Included (*PNI) warning labels to the products and brands we research considers whether a company\u2019s privacy policy indicates they can buy or sell personal information with data brokers. If we determine that they do, they earn a privacy \u2018ding\u2019. Many of the harms people experience online are the result of unchecked data collection &#8211; by data brokers and beyond. For example, sensitive health data collected in apps is <a href=\"https:\/\/www.sfchronicle.com\/opinion\/openforum\/article\/reproductive-rights-california-tech-17925695.php\">typically<\/a> <a href=\"https:\/\/blog.mozilla.org\/netpolicy\/2023\/08\/11\/mozilla-supports-updates-to-the-health-breach-notification-rule\/\">unprotected<\/a>, which can have serious consequences. Similarly, geolocation data for purchase <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2022\/08\/ftc-sues-kochava-selling-data-tracks-people-reproductive-health-clinics-places-worship-other\">poses a privacy and safety risk<\/a> for all Americans, but especially so for the most marginalized members of society and those who face the threat of violence such as those fleeing domestic abuse.<\/p>\n<p>At Mozilla, we\u2019ve worked to push the industry in a better direction. We build <a href=\"https:\/\/support.mozilla.org\/en-US\/kb\/enhanced-tracking-protection-firefox-desktop\">privacy<\/a> <a href=\"https:\/\/blog.mozilla.org\/security\/2018\/08\/13\/tls-1-3-published-in-firefox-today\/\">protections<\/a> into the browser to prevent data collection and <a href=\"https:\/\/monitor.firefox.com\/\">offer<\/a> <a href=\"https:\/\/relay.firefox.com\/\">tools<\/a> that make it harder for data brokers to create a detailed profile of consumers\u2019 online activity. We work to <a href=\"https:\/\/blog.mozilla.org\/en\/mozilla\/the-future-of-ads-and-privacy\/\">improve the advertising ecosystem<\/a>, where data brokers sell information to target consumers, and we help people navigate <a href=\"https:\/\/blog.mozilla.org\/en\/internet-culture\/deceptive-design-patterns\/\">deceptive design practices<\/a> that trick people into handing over their data in the first place.<\/p>\n<p>That said, we can only do so much in our <a href=\"https:\/\/blog.mozilla.org\/en\/products\/firefox\/firefox-tips\/internet-safety-for-families-total-cookie-protection\/\">products<\/a> and by holding companies to <a href=\"https:\/\/foundation.mozilla.org\/en\/campaigns\/equifax-breach\/\">account<\/a>. It\u2019s undeniable that consumer data powers today\u2019s internet. As CFPB Director Rohit Chopra noted at this week\u2019s <a href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/remarks-of-cfpb-director-rohit-chopra-at-white-house-roundtable-on-protecting-americans-from-harmful-data-broker-practices\/\">White House roundtable on data brokers<\/a>, AI only increases the reliance on vast troves of data. CFBP\u2019s efforts are vital and we applaud the move \u2013 but it\u2019s only a piece of the bigger picture.<\/p>\n<p>As a part of reigning in the data broker industry, consumers require a comprehensive legal framework. Federal privacy legislation, like last year\u2019s <a href=\"https:\/\/blog.mozilla.org\/netpolicy\/2022\/08\/24\/its-time-to-pass-u-s-federal-privacy-legislation\/\">American Data Privacy and Protection Act <\/a>(ADPPA), is critical to ensuring that people have agency over their online data and can truly benefit from technologies that improve their lives, without conceding to the exploitation of their personal data.<\/p>\n<p>We\u2019re pleased to see the <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2023\/08\/16\/readout-of-white-house-roundtable-on-protecting-americans-from-harmful-data-broker-practices\/\">White House<\/a> and CFPB tackle some of these hugely problematic practices, and are eager to delve into the CFPB\u2019s proposed rules when they\u2019re released.
